Bespoke Swimwear Terms and Conditions
Thanks for choosing to order Custom Smugglers with us!
As these pairs are made specifically for you, we're unable to
sell them to the general public. Because of this, there are a few terms and conditions to check out.
Our design team are legends, but they’re pretty busy! They can create up to 3 unique designs for you to look over, with a max of 3 revisions after that; further redesigns will be subject to a £25 design fee.
We understand colours are important. Please note that colours on the screen may vary to how they’re printed. Fluro colours in particular will look dull on screen, but come printed with a punch! If you are really particular about the colours you require, please supply us your specific colours in CMYK. If you need to be 110% sure, our designers will be happy to print a strike off for you, for a fee of £20. Please note this will extend your production time by 2 weeks. We will be unable to refund your order based on colour issues. So please opt for a strike off if the colours are super important!
Please note we are unable to refund/exchange due to incorrect sizing chosen. If you are unsure of sizing, please try a stock pair from the online store - or borrow a mate’s pair!
Once a design has been approved, we’ll send you an invoice which will include the sizes, intials, etc., as well as a design proof of your chosen design. Please check over the invoice and highlight any changes needed! Once paid, we’re locked in. Your invoice will be valid & guaranteed for 21 days; after that it will be closed, and any price changes that occur after this will be reflected in any new invoice.
This should rarely happen, but if your pairs are faulty, please let us know immediately! We will either be able to remake these for you if time permits, or we can organise a refund for faulty pairs. We’ll require the original pairs to be returned to us at our cost.
Production takes typically 4 weeks from receiving your payment, allowing a week for delivery. If you require your pairs for a specific date, please let us know as early as possible and prior to paying for the order. We will let you know if this is possible - and if so, we’ll do our best to meet this deadline. In the case where me wiss an agreed deadline for a specific event, then there are two options:
- We deliver the Smugglers at a 40% discount.
- We halt production (if midway) and you’ll be refunded any amount paid to date.
Please note that the 4 week timeline is a guide, and if there is a delay to this there will be no refund payable unless we’ve specifically agreed that we’ll delivery by a specific date, e.g. your wedding day.
CHANGE OF MIND:
Once you make your deposit or payment in full, the pairs will make their way swiftly into production within 24hrs. Once this happens, we will not be able to accommodate any change of mind on design or lower quantities, and we may not be able to issue a refund in part or in full. If you change your mind and the pairs are yet to enter production, we can refund the unmade pairs, however any setup fees will be non refundable.
INCORRECT DELIVERY ADDRESS:
Please double check your delivery address on your invoice, as this will be the address that your custom Smugglers will be delivered to. Budgy Smuggler is not responsible if the pairs are delivered to an incorrect address supplied by you - but we will help try to locate or redirect the parcel if possible. Our wish is to have you Smuggling in style as soon as possible!
What is a 'Made to Order' / Preorder product?
A “Made to order” is a product that is made from scratch in Australia when someone purchases it.
A "pre order" pair is in stock in our warehouse in Australia but not in the UK. If someone purchases from the UK store, we will then get it sent over from Australia.
How long will 'Made to Order' pairs take to make?
Good things come to those who wait!
Made to Order pairs take around 4 weeks to be made and processed, and another week for shipping, so you should receive your order within 4-5 weeks at most! We are usually able to deliver before this.
Pre order pairs arrive within 1-2 weeks.
Delivery times may vary depending on your location, shipping method, and other factors beyond our control.
What if I order the wrong size?
Please ensure you get the correct size.
As they are 'Made to Order' we are unable to refund or exchange them . Please read to our sizing chart to help make you correct decision.

It's been over 4 weeks, where is my pair?
No need to worry, if you received a confirmation email from us, your pair will still be on it's way!
Didn't receive a confirmation email? Check your spam/junk folder in case it ended up there.
If you are concerned as to how long your pre order is taking, shoot us an email email@example.com and we can provide an update.
What if I receive the wrong size?
We have had a shocker. Please reach out to firstname.lastname@example.org to let the crew know you have received an incorrect pair, with a photo of the pair. The team will then organise the correct pair to be sent out to you.
Can I exchange pre-order products?
Made to Order pairs are not able to be exchanged, as we only make the quantity of pairs we need to fulfil all the orders.
Therefore, we encourage you to double-check your sizing and design before placing your order to ensure that you're happy with your purchase.
In extenuating circumstances, Pre order items can be exchanged. Please email email@example.com to enquire.
Can I cancel my pre-order?
If your pair hasn't entered production, we can cancel your pre-order and issue you a full refund.
However, if it's already in production, we won't be able to cancel your order.
An analogy we like to use is you can’t un-bake a cake when you’ve paid for it to be made for you.
